Terms of Service

These Terms govern your use of the ADAfriendly platform, website, free scanner, accessibility widget, WordPress plugin, Shopify app, developer API, and any related services (collectively, the "Service"). By creating an account or using any part of the Service — including the free scanner without an account — you agree to these Terms.
1. What the Service is — and is not
ADAfriendly provides automated accessibility scanning, plain-English reporting, AI-assisted fix suggestions, remediation tooling, and monitoring for websites, measured primarily against the Web Content Accessibility Guidelines (WCAG).
The Service is an engineering tool, not legal advice. Nothing the Service produces — scan results, compliance scores, risk scores, reports, certificates, VPATs, or fix suggestions — is legal advice, a legal opinion, or a substitute for advice from a qualified attorney. Accessibility laws (including the ADA, Section 508, the AODA, and the European Accessibility Act) differ by jurisdiction and are applied by courts and regulators to specific facts. If you need to know your legal obligations or exposure, consult a lawyer.
2. No guarantee of compliance or protection from claims
Automated testing can only evaluate a subset of WCAG success criteria. A high score — including a score of 100 with zero detected issues — means our scanner found no violations in what it can measure. It does not mean your site is fully WCAG-conformant, ADA compliant, or compliant with any other law or standard. Full conformance requires human evaluation, including testing with assistive technology, which no automated tool can replace.
We do not guarantee that use of the Service will prevent accessibility-related lawsuits, demand letters, or regulatory action, and we are explicit — here and in our marketing — that no vendor can honestly make that promise. Anyone can file a claim regardless of a site's actual accessibility.
3. Scores, risk estimates, certificates, and VPATs
- Compliance scores summarize automated findings at a point in time. Your site changes; scores go stale.
- Lawsuit risk scores are statistical estimates derived from scan results and industry patterns. They are not predictions, probabilities of litigation, or legal assessments.
- Certificates and badges represent our good-faith record that an automated audit ran on a given date with the reported results — nothing more. They are not certifications of legal compliance, create no warranty to any third party, and must not be presented as legal proof of accessibility.
- Generated VPAT/ACR documents are drafts prepared from automated findings. Review and complete them with a qualified accessibility professional before publishing or including them in procurement responses.
- Items marked for manual review are cases where automated measurement is genuinely inconclusive. They require human judgment; leaving them unreviewed is your choice and your responsibility.
4. Eligibility
You must be at least 18 years old and have the authority to bind the entity you represent. The Service is not available to anyone barred from using it under applicable law.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@adafriendly.ai if you suspect unauthorized access.
6. Subscription and billing
Paid plans renew automatically each billing period until canceled. You can cancel at any time from the Account page; cancellation takes effect at the end of the current billing period. Payments are processed by Stripe. Plan limits (sites, pages per scan, AI features) are described on the pricing page and enforced by the Service. Refunds are handled case by case — contact support@adafriendly.ai.
7. Acceptable use
You agree not to:
- Scan sites you do not own or have explicit authorization to scan — this applies to the free scanner too
- Use the Service to perform denial-of-service or other abusive scanning
- Reverse-engineer or circumvent rate limits, authentication, or security controls
- Resell or rebrand the Service unless on an Agency plan with an explicit white-label license
- Use the Service to collect personal information about end-users of scanned sites
- Attempt to access other customers' data
- Misrepresent Service output — for example, presenting a certificate, score, or report as a government certification or legal determination
8. Your content and data
You retain all ownership rights in the sites and content you add to ADAfriendly. You grant us a limited license to crawl, scan, analyze, store, and display that content solely to provide the Service. Our handling of personal data is described in our Privacy Policy.
9. AI-generated content
The Service generates explanations, fix suggestions, alt text, and documents using third-party AI models. AI output can be wrong, incomplete, or inappropriate for your specific context. You are responsible for reviewing AI-generated content before deploying it to a production site. Where the scanner cannot determine a fact (for example, the background a text element actually renders on), the Service deliberately declines to generate a fix rather than guess — gaps in fix coverage are a feature of that policy, not a defect.
10. Automated fixes, plugins, and the widget
When you install our WordPress plugin or connect your Shopify store, you authorize the Service to make changes to your site's database (WordPress) or resources via the Shopify Admin API — for example, updating image alt text and injecting accessibility fixes. Every change is recorded in your dashboard audit log and access can be revoked at any time. Maintain your own backups. You are responsible for verifying that deployed fixes render correctly on your site.
The accessibility widget adds assistive display options for visitors. It enhances usability on top of your site's code; installing the widget does not by itself make a site accessible or compliant, and we do not market it as if it does.
11. Developer API
Developer API keys are subject to the rate limits and scope controls shown in your developer dashboard. You are responsible for keeping keys secret; revoke leaked keys immediately. API responses carry the same limitations as the rest of the Service, including everything in Sections 1–3.
12. Service availability
We aim for high availability but do not provide a formal SLA on self-serve plans. Scheduled scans may be delayed or retried. Enterprise SLAs are available by contract — contact support@adafriendly.ai.
13. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these Terms, engage in abuse, or fail to pay. Upon termination, your access to the Service ends and we delete your data per our Privacy Policy retention schedule.
14. Disclaimers
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted or error-free, that scan results will be complete or accurate, or that the Service will meet your specific compliance needs.
15. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, and including legal claims, demand letters, settlements, or judgments brought against you by third parties in connection with your site's accessibility — even if advised of the possibility. If you used only the free tier, our aggregate liability is limited to USD $100.
16. Indemnification
You agree to indemnify and hold harmless ADAfriendly and its affiliates from any claims arising out of (a) your misuse of the Service or violation of these Terms, (b) scanning sites without authorization, or (c) content or changes you deploy to your site, including fixes you chose not to review.
17. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Disputes shall be resolved in the state or federal courts located in Delaware.
18. Changes to these Terms
We may update these Terms from time to time. We will notify account holders at least 30 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
