Terms of Service

These Terms govern your use of the ADAfriendly platform, website, accessibility widget, WordPress plugin, Shopify app, and any related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms.
1. Eligibility
You must be at least 18 years old and have the authority to bind the entity you represent. The Service is not available to anyone barred from using it under applicable law.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@adafriendly.ai if you suspect unauthorized access.
3. Subscription and billing
Paid plans renew automatically each billing period until canceled. You can cancel at any time from the Account page; cancellation takes effect at the end of the current billing period. Payments are processed by Stripe. Refunds are handled case by case — contact billing@adafriendly.ai.
4. Use of the Service
You agree not to:
- Scan sites you do not own or have explicit authorization to scan
- Use the Service to perform denial-of-service or other abusive scanning
- Reverse-engineer or circumvent rate limits, authentication, or security controls
- Resell or rebrand the Service unless on an Agency plan with an explicit white-label license
- Use the Service to collect personal information about end-users of scanned sites
- Attempt to access other customers' data
5. Honest positioning on automated fixes
ADAfriendly provides automated scanning, fix generation, and remediation tools. We do not guarantee that use of the Service will prevent accessibility-related lawsuits or demand letters. Automated tools can identify and fix many accessibility issues, but some issues require manual testing and remediation by qualified accessibility professionals.
Unlike some competitors, we are explicit about what can and cannot be fixed automatically. Our compliance certificates represent our good-faith audit of the issues our scanner detected, not a legal guarantee of compliance with the ADA, WCAG, or any other standard.
6. Your content and data
You retain all ownership rights in the sites and content you add to ADAfriendly. You grant us a limited license to scan, analyze, store, and display the content solely for the purpose of providing the Service.
7. AI-generated content
The Service generates plain-English explanations, fix suggestions, and alt text using third-party AI (Claude by Anthropic). AI output may occasionally contain errors. You are responsible for reviewing AI-generated content before deploying it to your production site.
8. WordPress plugin and Shopify app
When you install our WordPress plugin or connect your Shopify store, you authorize the Service to make changes to your site's database (WordPress) or resources via the Shopify Admin API. These changes include, for example, updating image alt text and injecting accessibility fixes. You can review every change in your dashboard audit log and revoke access at any time.
9. Developer API
Developer API keys are subject to rate limits and scope controls disclosed at your developer dashboard. Leaked keys should be revoked immediately.
10. Service availability
We aim for high availability but do not provide a formal SLA on self-serve plans. Enterprise SLAs are available by contract — contact sales@adafriendly.ai.
11. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these Terms, engage in abuse, or fail to pay. Upon termination, your access to the Service ends and we delete your data per our Privacy Policy retention schedule.
12. Disclaimers
The Service is provided "as is." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or meet your specific compliance needs.
13. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility.
14. Indemnification
You agree to indemnify and hold harmless ADAfriendly and its affiliates from any claims arising out of your misuse of the Service or violation of these Terms.
15. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Disputes shall be resolved in the state or federal courts located in Delaware.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you at least 30 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
